NMC Health withdraws £2bn UK lawsuit against EY
Summary
NMC Health has withdrawn its nearly £2 billion lawsuit against EY in London, ending a years-long legal battle concerning allegedly negligent audits conducted between 2012 and 2018. The lawsuit, initiated by the administrators of NMC Health – a company founded in the UAE by BR Shetty that collapsed in 2020 due to undisclosed debts exceeding $4 billion – claimed EY failed to identify undisclosed guarantees and inaccuracies in the company’s accounts. A High Court trial took place from May to October, but before a ruling was issued, NMC withdrew the claim on January 29th. The court order stated there would be no award for damages or costs, and the settlement terms remain confidential. While Alvarez & Marsal, the administrators, accused EY of failing to detect fraud perpetrated by NMC’s shareholders, EY argued that the fraud was perpetrated by NMC’s own senior personnel. The case began after short-seller Muddy Waters questioned NMC’s finances in 2019, leading to a significant drop in the company’s share price.
