Opponents argue the summary is “fundamentally unfair” and misleading because it doesn’t clearly state the tax reduction would apply to long-term capital gains income, and incorrectly implies capital gains are excluded. The state constitution mandates the Attorney General provide a “fair, concise summary” of ballot initiatives, which appears on petition papers used to gather voter signatures. The plaintiffs contend the flawed summary should disqualify the measure from appearing on the ballot, as billions of dollars in tax revenue are at stake.
