AT&T Expands Lawsuit Against T-Mobile Over Misleading Advertising
Summary
AT&T has updated its lawsuit against T-Mobile, accusing the company of deceptive advertising practices. The core of the complaint centers around T-Mobile’s “Switching Made Easy” campaign, which promises significant savings and a 15-minute switching process. AT&T argues that these claims are “bogus,” citing unfair plan comparisons within the T-Mobile app and the unrealistic timeframe for a complete network switch.
Similar to a lawsuit filed by Verizon, AT&T claims T-Mobile misleads consumers by presenting savings based on inflated “rack rates” rather than actual customer bills. The lawsuit also takes issue with T-Mobile’s commercials featuring Billy Bob Thornton and Druski, which promote the 15-minute switching claim. AT&T previously engaged in a dispute with the BBB National Advertising Division (NAD) regarding its own advertising, which was settled out of court.
Beyond the advertising claims, the lawsuit also addresses T-Mobile’s alleged illegal scraping of AT&T customer account data. AT&T has obtained a preliminary injunction to prevent this practice and is seeking a permanent injunction. Despite the ongoing litigation, AT&T alleges that T-Mobile continues to offer the switching app to its customers, requesting bill details or plan information.
