Ex-wife loses lawsuit seeking share of former husband’s exit windfall

An Israeli court dismissed a woman’s lawsuit to claim half of her ex-husband’s profits from stock options that became valuable after their divorce.

Summary

The Family Court in Be'er Sheva rejected a lawsuit filed by a woman seeking NIS 2.5 million, half of her ex-husband’s proceeds from a company exit. The court ruled that the divorce agreement, signed in June 2020, included a clear waiver of any rights to the husband’s stock options. The ex-wife argued that her former husband concealed the potential value of the options, claiming she learned of the company’s successful merger through a news article. She sought to retroactively divide the NIS 4.76 million exit proceeds. However, Judge Shani Katz found that the ex-wife’s attempt to selectively reopen the divorce agreement was improper and inconsistent with legal precedent. The judge also determined that the husband did not intentionally conceal information, as the company was financially unstable at the time of the divorce and he genuinely believed the options were worthless. The court ordered the dismissal of the lawsuit and required the woman to pay NIS 45,000 in legal costs.
