Tata Steel arm faces $1.6 billion class action lawsuit in Dutch court over alleged health damage
Summary
Tata Steel has disclosed a $1.6 billion class action lawsuit filed in a Dutch court by Stichting Frisse Wind (SFW) against its Netherlands subsidiaries, Tata Steel Nederland B.V. and Tata Steel IJmuiden B.V. The lawsuit, filed under the Dutch Act on Collective Settlement of Mass Claims (WAMCA), alleges health impacts and diminished property values for residents near the company’s Velsen-Noord operations due to emissions of hazardous substances. SFW claims residents have experienced increased susceptibility to health issues and a loss of enjoyment of their homes, citing lower property values compared to similar areas.
Tata Steel refutes these claims, stating that SFW has not provided supporting evidence and characterizing the allegations as speculative. The company asserts it is fully prepared to defend the case and believes SFW will face challenges regarding both admissibility and the merits of the claim. The WAMCA process is divided into two phases – admissibility and merits – each expected to take two to three years, meaning discussions about compensation are not imminent.
Tata Steel also emphasized its ongoing investments in environmental improvements and community health initiatives around IJmuiden, including the Roadmap+ program and the Green Steel Plan agreed upon with the Dutch government, which aim to reduce emissions, particulate matter, noise, and other environmental impacts. Shares of Tata Steel experienced a slight decline following the announcement.
