B.C. market to pay $750,000 over washroom videos that ended up on Russian porn site

CP24 Toronto
Red Barn Market will pay $750,000 to settle a lawsuit after a former employee secretly filmed women in the washroom and uploaded the videos to a Russian porn site.

Summary

Red Barn Market has agreed to a $750,000 settlement in a class-action lawsuit stemming from a voyeurism case involving a former employee, Matthew Schwabe. Schwabe, a former assistant manager, was convicted in 2021 of voyeurism after secretly filming women in the washroom of a Saanich, B.C. market and uploading the images to a Russian pornography website. The B.C. Supreme Court ruling mandates that Schwabe surrender all recordings to the plaintiffs and assign all copyright of the material to them.

The settlement allocates funds to the victims, with $85,000 each awarded to five women whose images were distributed online, $25,000 to a woman whose images were not distributed, and $15,000 each to Jennifer Burke and Mallory Colter, the representative plaintiffs. Remaining funds will cover legal fees, with reductions for identified victims who were filmed but not publicly depicted.

The plaintiffs intend to donate a portion of their settlements to a charity supporting unidentified victims of Schwabe, who had previously filed for bankruptcy in 2018.
