Flagstar Financial, previously known as New York Community Bank (NYCB) until 2024, has agreed to a $1.23 million settlement regarding unfair ATM, NSF, and overdraft fees charged to its customers. The lawsuit alleged violations of bank policies and agreements with account holders. Two groups are eligible for payments: those charged retry NSF and/or overdraft fees between March 2, 2017, and January 1, 2020, and those charged multiple out-of-network ATM fees after a balance inquiry between August 20, 2020, and February 20, 2024. Individuals charged NSF or overdraft fees will receive a proportional share of the settlement based on fees paid, while those charged OON ATM fees will receive a flat payment of $25. No claim form is required; current account holders will receive credits, and former account holders will receive checks. The deadline to opt out is December 15, 2025, with final approval expected by January 13, 2026.
