AdaptHealth Corp. Tentatively Settles Overbilling Class Action
Summary
AdaptHealth Corp., a leading provider of home healthcare equipment, has reached a tentative settlement in a class action lawsuit accusing the company of overcharging patients for medical supplies that were either returned or already fully paid for. The lawsuit, filed in October 2022, alleged violations of state and federal debt collection laws. While AdaptHealth largely denies the allegations, mediation sessions in November 2025 and January 2026 led to the tentative agreement.
The settlement, if approved by the court, would establish a fund to resolve claims from the class of affected patients. U.S. District Judge Thomas D. Schroeder has paused case management deadlines to allow the parties three weeks to finalize the written settlement agreement. Plaintiffs’ counsel highlighted the success of the mediation process in reaching a resolution.
Analysts suggest that this settlement, like others of its kind, could influence future practices regarding billing disputes and regulatory compliance within the medical equipment industry. The case is Ray v. AdaptHealth Corp. et al., filed in the U.S. District Court for the Middle District of North Carolina under case number 1:22-cv-00898.
