The legal battle centers on whether the manufacturer failed to implement technology to prevent unauthorized use of their firearms. While an initial motions judge rejected the claim at the certification stage for failing to meet specific criteria, the Ontario Court of Appeal overturned that decision last year. The appellate court ruled that the original judge had set an unfairly high bar by requiring plaintiffs to essentially prove the merits of their case during the certification process.
