Amazon hit with another class action lawsuit over ‘excessive’ charges

The Independent
A class action lawsuit alleges Amazon systematically overcharged sales tax on third-party marketplace purchases in Tennessee.

Summary

An Amazon customer in Tennessee, Cullen Duke, has filed a class action lawsuit against the company, alleging systematic overcharging of sales tax on purchases made through its third-party marketplace. The complaint focuses on a 0.25 percent overcharge – a 9.5 percent tax rate applied instead of the correct 9.25 percent – for residents in unincorporated areas of Sullivan County. Duke’s lawyers contend that Amazon, functioning as a “marketplace facilitator,” bears the legal responsibility for accurate sales tax calculation and collection, and that customers are unable to recover these small overcharges directly from the state.

Despite Duke notifying Amazon of the issue in March 2025, the incorrect tax rate was allegedly continued to be applied, with Amazon later attempting to justify the charge by linking it to the item’s origin. The lawsuit aims to halt further overcharging, secure repayment for affected customers, and cover associated legal expenses and punitive damages. Amazon has not yet responded to requests for comment on the matter.

This lawsuit adds to a growing number of legal challenges facing Amazon, highlighting concerns over its pricing practices and responsibilities within its vast marketplace.
