Settlement in 23andMe data breach class-action proposed at about $4.49M
Summary
A proposed class-action settlement of approximately $4.49 million (US$3.25 million) has been reached between 23andMe and Canadians affected by a 2023 data security breach. The breach, which impacted almost seven million people globally including nearly 320,000 in Canada, compromised highly sensitive personal data, including health information, race, ethnicity, and family details.
The settlement applies to 23andMe customers in Canada between May 1, 2023, and October 1, 2023, who received notification of the breach. Eligible individuals can claim up to $2,500 for documented expenses incurred due to the breach, or approximately $17.77 without submitting proof of expenses.
23andMe maintains that the settlement is not an admission of guilt and is a compromise of disputed claims, occurring as part of the company’s insolvency proceedings after filing for bankruptcy in March. The proposed settlement is subject to approval by both United States and Canadian bankruptcy courts, and legal fees of 33% will be deducted from the total amount.
