Scots Motorists CAN sue Arnold Clark over dark web data leak
Summary
Lord Sandison of the Court of Session has granted permission for 15,000 Scottish motorists to pursue a class action compensation claim against Arnold Clark, following a data breach that saw customer information appear on the dark web in December 2022. The customers allege Arnold Clark failed to adequately protect their personal information after a cyber attack on its IT systems. Arnold Clark’s legal team, led by Roddy Dunlop KC, argued the case should be heard in the High Court in London alongside a similar action involving other customers, but Lord Sandison rejected this, stating the dispute has the strongest connection to Scotland. He emphasized that over 95% of claimants are domiciled in Scotland, the contracts were formed under Scots law, and the damages were suffered in Scotland. Solicitors Thompsons and Jones Whyte have been contacted by over 6,000 individuals regarding the breach and are building a case for “significant compensation” from Arnold Clark. Arnold Clark stated they have taken steps to protect affected customers, including establishing a call center with credit reporting agencies.
