Class action suit is latest challenge to Texas Ten Commandments law

A third lawsuit has been filed challenging Texas Senate Bill 10, which requires public schools to display the Ten Commandments in each classroom. Filed by a Guadalupe County family and 18 other multi-faith and nonreligious families, the class action lawsuit targets 16 school districts, including those in the San Antonio area. This legal challenge follows two earlier lawsuits that resulted in federal judges ruling SB 10 unconstitutional and issuing injunctions against its enforcement in specific districts, decisions which were paused pending appeal by Texas Attorney General Ken Paxton. Paxton maintains the Ten Commandments are foundational to U.S. law, while plaintiffs argue the law violates the separation of church and state. The American Civil Liberties Union of Texas and other organizations are representing the plaintiffs, arguing this lawsuit is the most effective way to protect the religious freedom of Texas public school children. The Fifth U.S. Circuit Court of Appeals is scheduled to hear arguments on the first lawsuit, along with a similar case from Louisiana, on January 20th.
