In June, Agua Special Utility District (Agua SUD) agreed to pay Performance Services Inc. (PSI) $95,000 to settle a 2022 lawsuit alleging that PSI defrauded the district. The dispute stemmed from an $11 million energy savings performance contract signed in 2018, which Agua SUD claimed was based on illusory promises. The settlement, finalized with a judge's order on June 23, includes a joint statement affirming the disagreement was a matter of good faith. Both parties agreed to terminate the contract's measurement and verification services and savings guarantee, refrain from disparaging comments, and drop counterclaims. Additionally, Agua SUD agreed to withdraw any pending complaints against PSI and its employees. This resolution comes as PSI remains a focal point of a widespread corruption investigation in western Hidalgo County.
