Lowe's Home Centers LLC failed in its attempt to dismiss a proposed class action lawsuit. The plaintiffs, Justin Bradshaw and Gustavo Lopez, alleged that the company collected and disclosed their personal information in violation of the pen register provisions of the California Invasion of Privacy Act. Judge Dana M. Sabraw of the US District Court for the Southern District of California ruled that the plaintiffs had adequately alleged they suffered concrete injuries and had a reasonable expectation of privacy in their browsing data. Sabraw noted that the plaintiffs had previously been denied standing, but the court found their new allegations sufficient to proceed with the case.
