U.S. District Judge Araceli Martínez-Olguín has dismissed a consumer lawsuit challenging the merger between Paramount and Warner Bros. Discovery (WBD), ruling that the plaintiffs failed to establish legal standing. The plaintiffs, a group of five streaming and pay-TV subscribers, argued that the acquisition would lead to higher prices and reduced diversity of viewpoints. However, the judge noted that the plaintiffs' claim of injury—a single historical price increase on Paramount+—was not suffered in the same way by all parties involved.
Despite the dismissal, the judge has granted the plaintiffs permission to file a revised complaint. This ruling is separate from other ongoing antitrust challenges against the merger brought by state attorneys general and the Writers Guild of America, which Martínez-Olguín is also presiding over. She has already set a trial date for those cases for March.
Paramount's legal team successfully argued that the plaintiffs failed to state a plausible claim of competitive harm. The lawsuit had also sought to prevent Skydance's acquisition of Paramount Global, which occurred last year.
