While these funds are intended to offset costs, many American consumers are filing class action lawsuits against major retailers and manufacturers, alleging that companies are pocketing the refunds instead of lowering prices.

Legal actions have been initiated against companies such as Five Below and Sony. In the case against Five Below, plaintiffs argue that the retailer increased prices to cover tariff costs but has not shared the subsequent refunds with customers. Similarly, Sony faces allegations of a "double recovery windfall" for raising PlayStation prices while simultaneously collecting significant tariff refunds.

Corporate responses to these claims vary significantly. While companies like Amazon, FedEx, and UPS have made various commitments to return recouped funds to customers, others like Nintendo have resisted, arguing that the tariffs were absorbed into the purchase price of goods and that refunds do not need to be passed on to consumers.
