Justice Dept. moves to dismiss Jan. 6 class action lawsuit

The Justice Department has filed a motion to dismiss a class action lawsuit brought by January 6 defendants under the Federal Tort Claims Act (FTCA). The defendants, who allege they suffered injuries due to "excessive police force" during the January 6, 2021, events, are arguing that their claims are legally barred because they failed to file administrative claims within the required timeframe.

According to the filing, the plaintiffs had until January 6, 2023, to initiate legal action under the FTCA. However, the Justice Department noted that the earliest claim from the named plaintiffs was not dated until July 29, 2025, significantly exceeding the two-year deadline. The department further noted that the submitted forms were incomplete, lacked signatures, and lacked necessary supporting documentation.

Separately, the filing mentions that Acting Attorney General Todd Blanche recently rescinded a $1.8 billion "anti-weaponization" fund intended to compensate allies of President Trump. While this rescission does not specifically address government restitution for convicted Jan. 6 rioters, legal experts suggest the move may have limited long-term legal effects regarding the fund's potential revival.
