Legal experts weigh in on South County ICE facility lawsuit

California Attorney General Rob Bonta and Santa Clara County officials have filed a lawsuit against the U.S. Department of Homeland Security, ICE, and Elmwood Capital Group to block the construction of a proposed ICE facility near Gilroy. The plaintiffs argue that the federal government has bypassed essential environmental reviews required by the National Environmental Policy Act (NEPA) and has ignored local zoning laws that reserve the Holsclaw Road property for agricultural use. While federal officials have denied plans for a detention center, blueprints suggest the facility could hold 150 people.

Legal experts highlight several complexities in the case. Environmental concerns include potential exposure to hazardous materials from the site's history of agricultural research and the risk of overwhelming the local septic system. While the Supremacy Clause may allow federal law to override local zoning, the plaintiffs argue that existing contractual obligations to preserve the land for agriculture should remain binding.
