Utah joins lawsuit against Hims and Hers alleging unauthorized subscriptions, data sharing

Headtopics
Utah has joined California and the FTC in suing Hims and Hers for unauthorized subscriptions and sharing health data with advertisers.

Summary

Utah Attorney General Derek Brown announced that Utah has joined California and the Federal Trade Commission in a lawsuit against telehealth company Hims and Hers, alleging the firm enrolled customers in unwanted prescription subscriptions via a deceptive "free consult" and made cancellation difficult, while also sharing sensitive health data with advertisers such as Meta and Snap despite promising privacy. The lawsuit seeks a permanent injunction, restitution, civil penalties, and disgorgement of profits. Brown said, "Despite being aware of consumers' struggles, Hims repeatedly chose not to provide simple mechanisms for consumers to stop recurring charges for medications they no longer want." Utah Department of Commerce Commissioner Margaret Woolley Busse added, "Our aim is to restore trust and protect consumers from deceptive practices. Hims' actions not only violate the law but also undermine Utahns' confidence in healthcare providers." Hims and Hers responded that the suit disregards evidence, ignores state telehealth laws, and is an attempt to generate headlines, vowing a vigorous defense.
