Instead of stabilizing the patient with a stent to seal the injury, the defendants aborted the procedure and withdrew the catheter. This failure allowed the dissection to expand significantly, leading to an emergent open-heart surgery during which the patient suffered a catastrophic stroke. The patient subsequently passed away seven months later due to complications from the stroke.

The settlement was reached without an admission of liability to avoid prolonged litigation. Amber Konow emphasized that while the case was difficult, the firm remains committed to pursuing trials to achieve closure for clients and ensure accountability in medical procedures.
