Second Lawsuit Challenging Trump's New Section 301 Tariffs Filed

A second lawsuit has been filed challenging the massive Section 301 tariffs imposed by Donald Trump. This new case, Learning Resources, Inc. v. United States, is led by toy manufacturer Learning Resources, Inc., a firm previously involved in significant IEEPA tariff litigation. The lawsuit was filed in the US Court of International Trade (CIT), which is considered the appropriate venue for such challenges.

The legal arguments in this complaint are similar to previous challenges, asserting that the Section 301 tariffs violate statutory requirements. Furthermore, the plaintiffs argue that if the president possesses the authority to impose such tariffs under Section 301, it would violate the constitutional nondelegation doctrine. Unlike a previous lawsuit filed by the Liberty Justice Center, this specific complaint does not invoke the major questions doctrine or seek class action certification, meaning any court relief would likely be limited to the specific plaintiff firms.

Legal experts anticipate that the CIT may consolidate this case with existing litigation regarding these tariffs. As legal challenges continue to mount, it is possible that more lawsuits from businesses, public interest groups, or state governments will follow.
