Novo Nordisk has sued Eli Lilly for allegedly using misleading comparative advertising for its GLP-1 medications.

Novo Nordisk A/S has filed a lawsuit in the United States District Court for the District of New Jersey against Eli Lilly and Company and Lilly USA, LLC. The lawsuit alleges violations of federal and state false advertising and unfair competition laws, specifically under the Lanham Act, regarding the marketing of Zepbound and Mounjaro.

Novo Nordisk claims that Lilly's direct-to-consumer advertising is materially misleading because it relies on outdated studies. Specifically, the complaint alleges that Lilly compares its highest injectable doses against lower doses of Novo Nordisk's products, while omitting data from newer FDA-approved options like Wegovy 7.2 mg. Novo Nordisk argues that these incomplete comparisons fail to provide patients with the evidence-based information necessary for making informed treatment decisions.

Through this legal action, Novo Nordisk is seeking a permanent injunction to force Lilly to remove the allegedly misleading comparative advertisements. If Lilly does not comply voluntarily, Novo Nordisk intends to seek a preliminary injunction to immediately block the campaigns.
