CT Joins Lawsuit Against Defense Dept. Over Wind Power

Connecticut Attorney General William Tong has joined a coalition of 18 other attorneys general to intervene in a lawsuit against the U.S. Department of Defense and Secretary Pete Hegseth. The lawsuit alleges that the department is unlawfully freezing routine reviews of land-based wind energy projects nationwide, a move the coalition claims violates the Administrative Procedure Act.

Under federal law, the Department of Defense is required to review wind projects for national security concerns, such as impacts on radar systems or flight paths. Since August 2025, the department has reportedly ceased the standard mitigation agreement process, causing projects to stall at various stages of development. This freeze, according to Tong, increases costs and obstructs the development of affordable, clean energy infrastructure.

The coalition argues that the department's sudden policy shift is arbitrary and capricious, as it has failed to provide a reasonable explanation or consider the economic harm to states, developers, and ratepayers. The plaintiffs are asking the court to order the agency to resume the legally required review and approval process for land-based wind projects.
