Court Voids Health Insurance Levy Filed After Wage Lawsuit Statute Expired

서울경제
Court voids health insurance levy on delayed wages, ruling statute of limitations cannot be extended by lawsuit delays.

Summary

Seoul High Court's Administrative Division 4-2 ruled that the National Health Insurance Service's levy of an additional 48.52 million won in settlement premiums on Korea Railroad Corporation for wages paid belatedly after an ordinary wage lawsuit (2011-2015) is void because the three-year statute of limitations for collecting such premiums had already expired. The court held that the statute's start date cannot be postponed by delayed wage payments resulting from litigation, emphasizing that a variable start point undermines the legislative purpose of a fixed limitations period and likens the health insurance collection system to taxation, where expired statutes bar any later levy. Consequently, Korail has no obligation to pay the disputed premiums, and the disposition is declared invalid.
