The Supreme Court has ordered the implementation of a mediated settlement in the long-standing dispute involving the family of the late real estate developer Ashok Varma.

Summary

The Supreme Court has ordered the implementation of a mediated settlement in the long-standing dispute involving the family of the late real estate developer Ashok Varma, related to the Ardee Group and associated family assets. A Bench comprising Justice JK Maheshwari and Justice Atul S Chandurkar acknowledged the progress made through mediation and instructed the parties to proceed with executing the terms of the settlement agreed upon during court-monitored mediation sessions. The dispute, which has been subject to extensive litigation over several years, chiefly involved Shefali Varma and Shibani Varma Kapur, daughters of Ashok Varma, concerning business interests, real estate assets, and properties held by the family through the Ardee Group. Resolution was facilitated through mediation overseen by former Supreme Court Judge Justice Kurian Joseph, appointed by the apex court to assist the parties in reaching an amicable conclusion. Earlier this year, Justice Kurian Joseph submitted an interim report to the Supreme Court, indicating that the primary disputes had been resolved through mediation. The report noted that a final and binding Memorandum of Settlement dated February 5, 2026, had been executed during these proceedings. The mediator informed the Court that additional time was needed to finalise a comprehensive settlement framework and complete implementation. The Supreme Court granted this time and directed the parties to continue with the agreed terms. This development is considered a significant breakthrough in a high-profile family business dispute connected to the Ardee Group, which had involved multiple legal forums and issues relating to ownership, management, and succession of valuable family assets accumulated over many years. The interim report confirmed that while the principal disputes were resolved, efforts were ongoing to ensure a comprehensive and enduring settlement with the cooperation of all involved stakeholders. The Supreme Court allowed time for the settlement's implementation but has retained judicial oversight with further hearings scheduled, indicating that the process remains under court supervision. The dispute attracted considerable attention due to its connection with Ardee City, one of Gurugram's earliest integrated residential townships, alongside prominent real estate and commercial assets linked to the Ardee Group. Progress through mediation is viewed as a major step towards ending years of contentious litigation. Sources familiar with the matter have indicated that the settlement resulted in a division of family-held assets and business interests between Shefali Varma and Shibani Varma Kapur. Ardee Mall in Sector 52, Gurugram, is reported to be allocated to Shefali Varma, while other properties and land parcels have been divided equally. The parties have not publicly commented on these details, and the Memorandum of Settlement's contents remain confidential. With the primary issues resolved and the Supreme Court directing implementation, the parties are closer to a comprehensive resolution after more than two decades of litigation. The settlement is expected to provide clarity on the future ownership and management of assets associated with the Ardee Group and bring closure to a long-standing legal dispute.
