Nintendo customers seek share of 'enormous' tariff refunds in new class action lawsuit
Summary
Following a Supreme Court ruling that declared President Donald Trump's tariff policy an unconstitutional overreach, the Trump administration began refunding approximately $166 billion to over 330,000 importers. This legal victory has prompted a wave of class action lawsuits, with gamers becoming the latest group to join the fight. On Wednesday, Gregory Hoffert and Prashant Sharan filed a lawsuit in the U.S. District Court for the Western District of Washington on behalf of millions of consumers who purchased goods from Nintendo during the tariff period. The complaint alleges that Nintendo of America passed the unlawful tariff costs on to consumers by raising prices, such as for a controller from $79.99 to $84.99 and a "Switch 2 Dock Set" from $109.99 to $119.99. The plaintiffs argue that because Nintendo has already recovered these costs from consumers, they are entitled to a portion of the government refunds. Nintendo of America had previously filed its own complaint seeking a refund with interest, and the new lawsuit references that filing to support their claim. This case mirrors a nearly identical lawsuit filed against Costco last month, highlighting a broader trend of consumers seeking restitution for inflated prices caused by trade policies.
