Plaintiffs in a class-action lawsuit against SiriusXM are requesting final approval from the U.S. District Court for Central Illinois for a $28 million settlement. The suit alleges violations of the Telephone Consumer Protection Act (TCPA) due to unsolicited telemarketing calls made to individuals who had registered their numbers on the national do-not-call registry and were not SiriusXM subscribers. Under the settlement terms, approximately 427,627 class members who filed claims are expected to receive a payment of $39.63 each. Any remaining funds after distribution will be donated to the National Consumer Law Center. SiriusXM has reportedly implemented changes to its telemarketing practices, including providing updated compliance rules to vendors and requiring them to remove consumers from call lists who are on SiriusXM’s do-not-call registry or are otherwise protected by state law.
