German Tourist Claims Damages Over Spicy Taco and Loses Lawsuit in New York

A German tourist sued a New York taco restaurant for $100,000 after claiming their salsa was too spicy, but the lawsuit was dismissed.

Summary

A German tourist, Faycal Manz, filed a lawsuit against Los Tacos No. 1 in New York City seeking $100,000 in damages after claiming the restaurant’s green salsa caused him physical and mental harm. Manz argued he experienced tachycardia and a “physical and mental shock” due to the spiciness, especially as he was unfamiliar with tacos from his hometown in Germany. However, Judge Dale Ho dismissed the case, stating that restaurants are not legally obligated to warn customers about the inherent spiciness of foods commonly known to be spicy, and that spiciness is often the desired quality in salsa.

Furthermore, the judge pointed out that Manz could have easily researched Mexican cuisine beforehand to understand the typical use of spices. This wasn’t Manz’s only legal action during his US trip; he also filed a lawsuit against a Walmart in New Jersey over Wi-Fi access and another against the NYPD for allegedly failing to respond to a 911 call regarding an assault, seeking $10 million in damages and changes to police protocols.

The court decision emphasized that spiciness is an inherent characteristic of salsa and that consumers should be aware of this when consuming Mexican cuisine.
