Plaintiffs claimed the system’s pre-collision braking, rear automated braking, and lane-keeping assist features could malfunction, sometimes activating brakes unnecessarily or causing steering issues. While Subaru denies any wrongdoing, they agreed to the settlement to avoid further litigation costs. The agreement provides affected owners with an extension of their original warranty by one year or 12,000 miles, and covers a percentage of qualifying EyeSight repairs – 100% within the original warranty period, and 75% during the extension. Named plaintiffs will receive $5,000 each, and plaintiffs’ lawyers were awarded over $2.4 million in fees. Subaru owners who owned a vehicle between 2013 and 2021 should check if their car is equipped with EyeSight and await a settlement notice with instructions on eligibility for warranty extensions or reimbursements.
