Montreal care home faces approved class-action over COVID deaths
Summary
A Quebec judge has authorized a class-action lawsuit against Résidence Angelica, a private long-term care home in Montreal North, regarding its handling of a COVID-19 outbreak in 2020 that resulted in at least 68 resident deaths. The lawsuit, led by plaintiff Antonio Capobianco, claims the residence’s actions contributed to the death of his mother, Filomena Greco, and other residents, as well as causing lasting harm to survivors and their families.
The suit alleges failures in outbreak management, specifically the transfer of COVID-positive patients to units with uninfected individuals and a disregard for government-mandated infection control procedures, including allowing sick staff to work. The plaintiffs are seeking damages on behalf of residents who lived at the home between April 9 and June 26, 2020, and their families.
The allegations have not yet been proven in court, and Résidence Angelica has not yet issued a comment on the matter.
