Gast Construction Co. of Wahpeton, North Dakota, has filed a lawsuit against Myrtha Pools USA, Inc., seeking $298,680 for unpaid invoices stemming from emergency repairs at the Fargo Park District’s Island Park Pool. The dispute originated from a remodeling project where Myrtha Pools was a subcontractor responsible for the pool structure's design and supply. Damage to the pool’s wall panels halted work in July 2024, leading to a remediation contract in December 2024 where Myrtha agreed to cover repair costs up to $298,680, confirmed in writing by their chief technical officer, John Ireland. Gast completed the repairs by early 2025, and the pool reopened for the summer season. Despite issuing a certificate of substantial completion, Myrtha has allegedly failed to pay the two invoices submitted by Gast totaling the agreed-upon amount. Gast is alleging breach of contract and unjust enrichment, also seeking attorney’s fees and court costs.
