A second plaintiff’s claims were dismissed, but she was given leave to amend her complaint. The judge acknowledged the statistics showing Tesla’s H-1B hiring during layoffs but stated they didn’t definitively prove a preference for foreign workers. The alleged recruiter comment remains a key factor in keeping the lawsuit alive.
