Apple Responds to Lawsuit Filed by Three YouTube Channels

MacRumors
Apple has countered a lawsuit alleging it illegally scraped YouTube videos for AI training, arguing the content was publicly accessible and permitted under copyright law.

Summary

Three YouTube channels, including h3h3Productions, MrShortGame Golf, and Golfholics, sued Apple in April, accusing the company of violating the U.S. Digital Millennium Copyright Act (DMCA) by unlawfully accessing and scraping millions of copyrighted videos to train its AI models. The channels claimed Apple "deliberately circumvented" YouTube's protections and profited from content used without compensation. In its response, Apple argued that the plaintiffs posted the videos publicly on YouTube and that the company was permitted to access them under the DMCA and YouTube's Terms of Service. Apple stated that because the videos are publicly accessible without passwords or locks, the alleged technological measures do not control access to the works as required by law. Consequently, Apple requested that the court dismiss the lawsuit, asserting that the plaintiffs have failed to state a valid claim.
