In its response, Apple argued that the plaintiffs posted the videos publicly on YouTube and that the company was permitted to access them under the DMCA and YouTube's Terms of Service. Apple stated that because the videos are publicly accessible without passwords or locks, the alleged technological measures do not control access to the works as required by law. Consequently, Apple requested that the court dismiss the lawsuit, asserting that the plaintiffs have failed to state a valid claim.
