West Virginia joins lawsuit challenging California Plastics Act
Summary
West Virginia Attorney General J.B. McCuskey has joined a coalition of 15 other states and the National Association of Wholesaler-Distributors to challenge California's Plastics Act. The lawsuit argues that the act imposes radical packaging requirements and fees that discriminate against out-of-state businesses and will ultimately drive up the cost of everyday goods for consumers.
Joining West Virginia and Texas in the complaint are attorneys general from Alabama, Florida, Georgia, Idaho, Iowa, Louisiana, Missouri, Montana, Nebraska, North Dakota, Oklahoma, South Carolina, South Dakota, and Utah. The lawsuit seeks a declaratory judgment that the act violates both the United States and California Constitutions.
