A class action lawsuit challenges Disney's use of facial recognition at park entrances, alleging insufficient disclosure and consent.

Summary

A new class action lawsuit has been filed against The Walt Disney Company in California federal court, challenging the use of facial recognition technology at Disneyland and Disney California Adventure Park. The suit alleges that guests are not properly informed when their biometric data is being collected and that the system violates California consumer protection and privacy laws. The complaint claims Disney collects and compares photographs of guests' faces to ticket and annual pass images without providing adequate disclosure or consent. "Guests should be able to expressly opt in to this type of sensitive facial recognition technology with written consent," attorney Blake Yagman wrote in the complaint. "The onus of privacy rights should not be on the victim." Disney's privacy policy states that biometric data is deleted within 30 days and participation is optional, with alternative lanes available. The proposed suit is seeking at least $5 million in damages on behalf of affected guests.
