‘Very long journey’: Settlement approved in $10M mall collapse lawsuit

A judge approved a $10 million settlement for victims of the 2012 Elliot Lake mall collapse, with approximately $6 million available after expenses.

Summary

A judge has approved a $10 million class-action settlement for those impacted by the 2012 Algo Centre Mall collapse in Elliot Lake, Ontario, which killed two women and injured nineteen others. Justice Benjamin Glustein stated the settlement offers “fairness and towards closure” for the approximately 300 individuals affected, including shoppers, business owners, and workers. While the settlement amount is $10 million, the actual funds available for distribution will be closer to $6 million after legal fees, administrative costs, and other expenses.

The lawsuit alleged negligence by multiple parties involved with the mall, including owners, building inspectors, and an engineering firm. Key defendants contributing to the settlement include the City of Elliot Lake ($3.5 million), Algoma Central Properties ($2 million), and Eastwood Mall Inc. ($1.745 million). No defendant is admitting liability.

The lead plaintiffs, Jack and Elaine Quinte, who owned a restaurant in the mall and were directly impacted by the collapse, expressed relief at the nearing end of a 14-year legal battle. The judge is expected to release a written ruling next week and will also consider awarding an honorarium to the Quintes for their dedication to the case.
