Oral arguments scheduled in Scottsdale's 'Axon bill' lawsuit
Summary
Two lawsuits filed by Taxpayers Against Awful Apartment Zoning Exemptions (TAAAZE) are challenging a development agreement between the city of Scottsdale and Axon, a Taser manufacturer. The core of the dispute revolves around Senate Bill 1543, dubbed the 'Axon Bill,' which allows Axon to bypass a city referendum and build a large-scale office, apartment, and hotel complex. TAAAZE argues the bill is unconstitutional and unfairly benefits Axon, while Axon and the state contend it’s a legitimate exercise of state power to encourage economic development.
Oral arguments are scheduled for April 10th before Maricopa County Superior Court Judge Herrod regarding one of the lawsuits, with a ruling expected by July. A second lawsuit challenges the memorandum of understanding (MOU) between Axon and Scottsdale, and the city has requested a stay on that case pending the outcome of the first. The Arizona Chamber of Commerce has filed a brief opposing the lawsuit, warning of the negative impact on economic growth if TAAAZE prevails.
The dispute centers on Axon’s plan to build a 1,200-unit residential complex, a hotel, and a new office near Hayden Road and the Loop 101. The city initially approved a plan for up to 1,900 apartments, but Axon negotiated a reduction as part of the agreement. TAAAZE alleges the city did not follow proper procedures, including a housing impact statement and public hearing, and that Axon received undue perks in the MOU.
