Tourists might be able to join South West Water legal claim
Summary
A prospective class action lawsuit against South West Water has been expanded to potentially include tourists who regularly visit affected areas of Devon and Cornwall. The claim, brought by law firm Leigh Day, initially included residents and businesses from Exmouth, Lympstone, and Budleigh Salterton, but now encompasses Dawlish, Sidmouth, Teignmouth, Newquay, and Penzance. Leigh Day has indicated that regular visitors who can demonstrate specific harm beyond that suffered by the general public may be eligible to join the claim. The lawsuit stems from sewage discharges, such as the closure of Exmouth beach in August 2024. South West Water has acknowledged the claim and stated its commitment to bathing water quality, but has not provided further comment. Leigh Day has sent a Letter Before Action (LBA) to South West Water, giving them until May 6, 2026, to respond, after which formal court proceedings may be initiated if a settlement isn't reached.
