Costco faces yet another lawsuit over its rotisserie chicken
Summary
Costco is being sued in a proposed class action lawsuit concerning its popular $4.99 rotisserie chickens. The suit, filed on February 12th, alleges high levels of salmonella contamination originating from the farm in Fremont, Nebraska, that supplies Costco. According to a report by Farm Forward, the farm repeatedly failed USDA standards, with salmonella found in a significant percentage of chickens and chicken parts since 2019. Plaintiff Lisa Taylor claims she was misled about the safety and quality of the chicken. The lawsuit seeks damages for customers who purchased rotisserie chicken and raw chicken parts after January 1, 2019.
This lawsuit follows another recent claim accusing Costco of falsely advertising its rotisserie chicken as containing “no preservatives,” specifically citing sodium phosphate and carrageenan as added ingredients. Costco responded to that claim by stating they removed signage suggesting the absence of preservatives and that the ingredients are used for quality and are approved by food safety authorities.
Costco sold over 157 million rotisserie chickens worldwide in 2025, according to the company. USA TODAY reached out to Costco for comment on the salmonella lawsuit but did not receive a response.
