Kotex class action alleges tampons contain undisclosed lead

A class action lawsuit has been filed against Kimberly-Clark Corp. by plaintiff Stephanie Foster, alleging that the company’s U by Kotex Click tampons contain lead which is not disclosed to consumers. Foster claims Kimberly-Clark misleadingly markets these tampons as containing “no harsh ingredients” and being “pesticide free,” leading consumers to believe they are free from harmful substances. Independent testing reportedly commissioned by Foster’s counsel found a “substantial amount” of lead in all sizes of the tampons. The lawsuit asserts that consumers would not have purchased the product if they had known about the lead content and accuses Kimberly-Clark of negligent misrepresentation, unjust enrichment, and violations of consumer protection laws. Foster seeks declaratory and injunctive relief, as well as damages for herself and other class members. This lawsuit follows a similar case filed last year against Procter & Gamble regarding lead levels in their Tampax-brand tampons.
