Fireball, Parrot Bay drinkers win class action lawsuit certification over lookalike malt drink labels
Summary
A New York federal judge has certified two class action lawsuits against Sazerac Co. Inc., allowing consumers Sharon Pizarro and Cindy Koonce to proceed with their claims. The lawsuits allege that Sazerac’s labeling of its Fireball and Parrot Bay malt-based alcoholic beverages is misleading, leading consumers to believe they contain distilled spirits when they are, in fact, malt-based. The plaintiffs argue that the packaging and labels of these malt beverages closely resemble those of Sazerac’s distilled spirits products, Fireball Cinnamon Whisky and Parrot Bay Rum, violating New York General Business Law. Judge Kenneth Karas determined the plaintiffs met the requirements for class certification, including demonstrating commonality and typicality of claims. The class action seeks to represent all individuals who purchased the affected Fireball or Parrot Bay products in New York during the relevant period. This case follows a similar lawsuit against Cinco Spirits Group regarding the advertising of its tequila.
