Federal court approves class action lawsuit for Richmond fire
Summary
A federal court has approved a class action lawsuit on behalf of over 2,000 Richmond, Indiana residents displaced by a large warehouse fire that occurred on April 11, 2023. The lawsuit, filed by Tushawn Craig and Marquetta Stokes, alleges negligence on the part of property owners Seth Smith and Cornerstone Trading Group, as well as the City of Richmond, for failing to address known fire hazards at the facility. Residents claim exposure to harmful substances and are seeking compensation for property damage, health issues, lost wages, and evacuation expenses.
The City of Richmond had previously cited the property for fire hazards in 2019, including excessive plastic storage and insufficient fire suppression, but took no action. The fire marshal ruled the cause of the fire as “undetermined.” The city has reportedly spent $204,716 on legal fees since April 2023, leading to frustration among residents like Tushawn Craig, who question why funds are available for legal defense but not for compensating those affected.
Plaintiffs, including Troy Wilson, who became terminally ill after the fire, believe the blaze exacerbated existing health conditions. Attorney Trevor Crossen is representing the plaintiffs and emphasizes the dangers of industrial negligence, urging the city to take responsibility and settle with the impacted residents.
