The Dos and Don’ts of a DUI

States prohibit driving under the influence of alcohol or drugs and being arrested under suspicion of driving under the influence can result in severe consequences. DUI charges can result in heavy fines, community service, and prison time, with increasing penalties if the crime is committed again. Since DUIs are so severe, it can be terrifying if traffic police pull you over under suspicion of driving under the influence.

This article will describe what you can do to avoid any situation where a DUI is possible and give tips on what you should and should not do if pulled over by a police officer.

DO: Plan Your Transportation Ahead of Time

If you are going out for a drink, ensure you plan for your journey back home beforehand. Ride-sharing apps like Uber and Lyft are excellent options for such situations. If rideshare apps are unavailable in the area, you can use the taxi services available.

Another great alternative is to choose a designated driver. This person you trust will not drink and will drive you home. Also, use delivery services instead of going to the store for additional alcohol.

“The best way to stay free of DUI convictions is to have a plan of how you are going to get home that does not leave you behind the wheel of a vehicle.” says attorney Ryan Brown of J. Ryan Brown Law.” Remember, some states do not permit any expungement of DUI convictions, not to mention the danger to yourself and others. A criminal record could negatively affect your career or child custody battles. Simply put, just plan out your transportation ahead of time.

DONT:  Try to Negotiate

After being pulled over by the police, many have the instinct to try and talk their way out of the situation. This hardly works and only worsens the situation. Talking a lot might indicate that you have had too much to drink.  Moreover, prosecutors could use the statements you make against you in court. Avoid making unnecessary remarks during your arrest. Instead, be respectful to the officer in charge, and don’t be afraid to invoke your right to remain silent.

DO: Hire an Experienced Attorney

The first and most crucial step after getting arrested for DUI is hiring an attorney. If your license has been suspended, they will help you appeal this decision with the DMV. There is typically a strict timeline imposed on you when you are trying to get your license back! If the officer who arrested you is not present during the appeal, you might have your license reinstated.

Final Thoughts

With the number of drunk driving crashes going up each year, it is imperative to take all measures to reverse this trend. Drunk driving will lead to fatal accidents and have profound legal implications for all parties involved. Stay safe, and do not drink and drive.
